La Audiencia de Tarragona desestima la posibilidad de demandar a un fondo buitre por cláusulas abusivas, al considerar que no son titulares del crédito en si mismos, y que no existe cesión de crédito, sino «titulización de hipoteca», y que por tanto el fondo únicamente es titular de participaciones y cédulas hipotecarias.
Aunque la sentencia no lo menciona, parece lógico pensar que la demanda debía haberse interpuesto contra la entidad financiera que concedió el crédito, al entender la Audiencia que de hecho sigue siendo titular del mismo.
